1. Introduction & Acceptance of Terms

Welcome to Petit Whisk. By accessing our website, browsing our products, or placing an order, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. We operate as a fully council-approved home-based bakery in New South Wales, Australia, strictly adhering to the health and food safety regulations set by the NSW Food Authority. We reserve the right to update or modify these Terms at any time without prior notice.

2. Orders, Pricing & Payments

Pricing & Minimum Order: All prices listed on our website are in Australian Dollars (AUD). To maintain our quality and service standards, a minimum order amount of $48 AUD applies to all online purchases (excluding delivery fees).

Order Acceptance & Cancellation: We reserve the right to accept, decline, or cancel any order at our sole discretion. This includes, but is not limited to, situations involving ingredient shortages, unforeseen high order volumes, or pricing errors on our website. If we cancel your order after payment has been processed, we will issue a full refund in 2-3 business days.

3. Allergen & Cross-Contamination Disclaimer

While we provide detailed ingredient and allergen information for every product on our website, please be advised that our desserts are handcrafted in a workspace where a variety of ingredients are processed.

We regularly handle common allergens, including, but not limited to, dairy, eggs, gluten, tree nuts, peanuts, and soy. Despite maintaining strict hygiene and cleaning standards in accordance with NSW Food Authority guidelines, we cannot guarantee a completely allergen-free environment due to the potential for cross-contamination through shared baking equipment.

For your safety and peace of mind, we kindly ask that you carefully evaluate your specific health conditions and dietary restrictions before placing an order. By proceeding with a purchase, you acknowledge our working environment and kindly accept any potential risks related to cross-contamination.

4. Product Care & Storage

Our desserts are freshly handcrafted without artificial preservatives and are highly perishable. All products must be refrigerated immediately upon receipt and strictly maintained at a temperature between 2°C and 4°C. For optimal taste, quality, and food safety, all items must be consumed within 1 to 2 days from the date of delivery or collection.

Petit Whisk accepts no liability for any food safety issues, spoilage, or loss of quality resulting from improper storage, temperature abuse (including storing above 4°C), or failure to consume the product within the strict 1-2 day timeframe after the order has been handed over.

5. Delivery Policy & Assumption of Risk

We operate a fixed delivery schedule within our designated local zones. Because our items are temperature-sensitive, it is highly recommended that someone is present to receive the delivery. If no one is available at the delivery address, our driver will contact you. If instructed to leave the package unattended, or if we cannot reach you, the items will be left in the safest accessible location at the premises. From the moment the items are delivered or left unattended, all liability and risk regarding temperature control, theft, or damage passes entirely to the customer.

6. Return & Refund Policy

Due to the fresh nature of our products and in strict compliance with NSW Food Authority health and safety regulations, we cannot accept physical returns of any food items once they have been collected or delivered. We do not offer refunds or exchanges if you change your mind, order the wrong item, or if the product does not meet your subjective taste preferences. All sales are final. Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. If you believe your dessert is faulty, spoiled, or significantly different from its description, please contact us within 24 hours of receiving your order with clear photographs of the issue. Upon assessment, if the fault is confirmed on our end, we will gladly offer a replacement, store credit, or a full refund.

7. Intellectual Property

All content on this website, including but not limited to text, graphics, logos, images, product designs, and recipes, is the property of Petit Whisk and is protected by Australian and international copyright laws. Unauthorised use, reproduction, or distribution of any content is strictly prohibited.

8. Limitation of Liability

To the maximum extent permitted by the Australian Consumer Law, Petit Whisk’s liability for any claim, loss, or damage arising from our products or services is strictly limited to the purchase price of the specific order in question. We shall not be held liable for any indirect, incidental, special, or consequential damages resulting from the use or inability to use our products or services.

9. General Provisions

9.1 Severability:

If any provision of these Terms of Service is determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms. Such determination shall not affect the validity and enforceability of any other remaining provisions.

9.2 Entire Agreement:

These Terms of Service and any policies or operating rules posted by us on this website constitute the entire agreement and understanding between you and us, superseding any prior or contemporaneous agreements, communications, and proposals, whether oral or written.

9.3 Right to Amend:

We reserve the right, at our sole discretion, to update, change or replace any part of these Terms of Service by posting updates and changes to our website. Your continued use of or access to our website following the posting of any changes constitutes acceptance of those changes.
